SC Grants Leave To Appeal Against Judgment On Anura Bandaranaike's Last Will

The Supreme Court has granted leave to appeal challenging a judgment of the Western Province’s Civil Appellate High Court which declined to accept a photocopy of an alleged last will as evidence to the late Anura Bandaranaike’s testamentary case.

S.A. Wasantha Samarasekara of Nawagamuwa Pelawatta, Nittambuwa a security officer of the late Anura Bandaranaike who is also a claimant to this property filed an appeal in Supreme Court against Civil Appellate Court’s judgment and the Supreme Court to be heard this appeal on September 12.

This testamentary action had been filed by Ms. Sunethra Bandaranaike before Colombo District Court on the basis of intestacy claiming the property of the late Anura Bandaranaike which is estimated to be worth over Rs.1,183 million.

However, four claimants including Wasantha Samarasekara who were closely associated with the late Anura Bandaranaike had also presented a photocopy of the alleged last will claiming for the said property. However, in its judgment, the Western Province’s Civil Appellate High Court refused to accept the alleged last will as evidence to the testamentary case.

Anura Bandaranaike died on 16 March 2008 in Colombo at his official residence, Visumpaya, period of prolonged illness due to the cancer that had been dignosed few years ago for which he was hospitalized for several months
