Malaka Silva's Bail Application Refused!

November 04, 2014

Colombo Additional Magistrate M. Sahabdeen today refused the bail application filed by Minister Mervyn Silva’s son Malaka Silva and remanded him until November 18.

While dismissing objections raised by the defence, the Additional Magistrate also ordered an identification to identify the suspects. Malaka Silva, who was arrested by Police on Saturday, after allegedly assaulting a foreign couple was not present in the court today as he was in hospital.

Malaka Silva’s bail application was refused on the grounds that his release might influence the witnesses of the case.

The Magistrate also said he would visit the private hospital, where Malaka Silva is receiving medical treatment, to inspect his condition.

The Magistrate also ordered the JMO report be produced on November 11.

Addressing a press conference on Sunday, Police Media Spokesman SSP Ajith Rohana explained the circumstances which led to the arrest of Malaka Silva.

“The incident occurred at a nightclub on Duplication Road in Colombo 4. The incident occurred between 1 and 3:30 a.m. and a complaint was first lodged at the Bambalapitiya Police. The complaint was that the individual known as Malaka Silva had been assaulted by a foreign national. The Bambalapitiya Police initiated investigations based on this complaint,” the Police media spokesman said.

“Subsequently, the Colombo Crimes Division took over the investigation. Investigations were carried out under the supervision of an ASP and the OIC of the Crimes Division. Facts regarding the incident came to light during the course of the investigation. There is dancing that takes place at this nightclub for various groups,” he also added.
