The Commercial High Court of the Western Province has issued interim enjoining orders against several individuals involved in the printing and sale of counterfeit copies of the award-winning novel Mai Mara Prasangaya, authored by Mahinda Prasad Masimbula. The orders were issued on 26 November.
Masimbula, filing the case as both the author and publisher, sought the intervention of the Court to safeguard his commercial rights. The legal action was initiated under the provisions of the Intellectual Property Act. Submitting the facts to the Court, the plaintiff stated that the defendants had printed fake copies of the book and were selling them to the public. Consequently, the plaintiff requested the Court to issue orders preventing these illegal activities and sought several reliefs, including the disclosure of the identities of the sellers involved.
Taking these submissions into consideration, High Court Judge Amali Ranaweera issued enjoining orders against the defendants, effective until 10 December. Attorneys-at-Law Buddhika Illangatillake, Vinura Kularatne, Chaturi Jayasuriya, and Sanjaya Fonseka appeared on behalf of the plaintiff.
