Suspended PC Calls for Impartial Probe After Alleged Clash with NPP MP

A Police Constable from the Suriyakanda Police Station has formally petitioned the Human Rights Commission (HRC) in Ratnapura, seeking an impartial investigation into an altercation with National People’s Power (NPP) MP Shantha Pathma Kumara. The officer, currently under suspension and released on bail, claims the incident has left his family in severe financial distress.

Speaking to the media following his complaint to the HRCSL on 26 December 2025, the constable detailed the personal toll of his suspension. He revealed he recently underwent bypass surgery, a procedure funded through loans he is now unable to repay.

“I support a family of four, including two children preparing for their Grade 5 Scholarship and O-Level exams. I have been without an income since my arrest. I was performing my official duties, yet no action has been taken against the MP who assaulted me,” the officer stated.

The constable maintains that he was targeted for his involvement in a police operation and alleges that the MP, along with several others, physically assaulted him and seized his motorcycle while he was returning home from duty.

The constable’s wife, Pushpa Malakanthi, raised further concerns regarding the treatment of their children. She alleged that the MP’s wife, who is a staff member at the same school in Kalugala, has used social media to disparage the constable.

Malakanthi claimed this has created a hostile environment:

  • Social Media Posts: She claims to have proof of posts made by the MP’s wife accusing the constable of wrongdoing.
  • Impact on Children: The children have reportedly refused to attend school due to perceived discrimination and embarrassment.
  • Principal’s Intervention: Malakanthi has called upon the school principal to ensure that teachers do not involve children in political or legal disputes.

In a statement to BBC Sinhala, NPP MP Shantha Pathma Kumara rejected the constable’s version of events, describing the claims as a campaign to damage his reputation.

The MP clarified that the land in question belongs to his wife’s sister, not himself. He stated the land had been abandoned for 15 years before two local youths began cultivating beans there. He alleged that on 16 December, police “produced” cannabis plants in pots to implicate the youths, one of whom was later fined.

The MP alleged that on 20 December, the constable—who appeared to be intoxicated—blocked his path with a motorcycle and attempted to force open his vehicle door.

The MP said he believes the confrontation was a reaction to him naming specific police officers in Parliament on 19 December regarding a breach of privilege.

Following the incident, the MP lodged a complaint with the Kolonna Police, leading to the constable’s arrest for criminal intimidation and obstruction.

Assistant Superintendent of Police F. U. Wootler informed BBC Sinhala that the constable’s claims of assault and the seizure of his motorcycle have not been substantiated by preliminary investigations or medical evidence. Clinical records at the time of the constable’s hospital admission reportedly noted the smell of alcohol on his breath, though further blood tests have been sent to the Government Analyst.

The constable remains on bail of Rs. 200,000, and investigations into the conflicting complaints from both the officer and the MP are ongoing.
