President Issued Notice In Fundamental Rights Petition

The Supreme Court on Monday issued notices a group of individuals including the President, the Prime Minister, and several Cabinet Ministers.

The court issued notices when a petition filed by Nobel Resources Pvt. Ltd. was considered. The petitioner says that irregularities occurred when awarding tenders for the supply of coal to the thermal power plant in Norochcholai. The petition was heard by a bench headed by Chief Justice  K. Sri Pavan.

The petitioner said that the tender has been awarded to a company called “Swiss Singapore”, not considering its bid which was lower.

Objection was raised by the respondents, who argued that under the Constitution of the country, the executive president could not be made a respondent. Therefore, the petition must be rejected, respondents said.

However, the Supreme Court said that the President can be made a respondent in a petition pertaining to his action as a Minister.
