Court Issues An Enjoining Order To Stop The Inquiry At Swimming Club

The District Court of Colombo (03.15.2017) issued an enjoining order restraining the General Committee of the Colombo Swimming Club from conducting an inquiry that was appointed to look in to a Complaint made by a Member against the President’s membership of the Club.
The enjoining order was sought to restrain the top chairs of swimming club based on the appointment of the inquiry panel which is said to have violated the Constitution of the Club, the Plaintiff’s contention was that an impartial inquiry panel has not been appointed in terms of the constitution.
Attorneys-at-Law, Mr. Isuru Balapatabendi with Mr. Charaka Jayaratne instructed by Mr. Sajaya Fonseka, appeared and obtained the enjoining order on behalf of the Plaintiffs.
Attorneys-at-Law, Mr. Avindra Rodrigo and Mohamed Adamaly appeared for some of the Defendants including the President of the club, wherein Mr. Suren de Silva Attorney-at-Law appeared in person and made submissions as a General Committee Member.
