Court Rejects Request to Name Wasantha Samarasinghe, Others as Suspects

The Mount Lavinia Magistrate’s Court today (26) rejected a request made by the complainant to name Wasantha Samarasinghe, Mahinda Jayasinghe, and Ranjan Jayalal as suspects and to produce them before court.

Delivering the order, Magistrate Pasan Amarasinghe noted that an investigation into the disputed property is still ongoing by the Colombo Fraud Investigation Bureau and that steps have already been taken to refer the matter to the Attorney General to obtain instructions.

The Magistrate emphasised that no order had been issued for the arrest of the three individuals, nor have they been named as suspects in this case at present. He further explained that during an ongoing investigation, a magistrate cannot halt or override the process of seeking instructions from the Attorney General.

The order also noted that investigators are entitled to obtain the Attorney General’s advice if there is no conclusive suspicion of a criminal offence relating to the property in question.

Accordingly, the court rejected the complainant’s request to instruct police to name the three individuals as suspects and produce them before court.

The case is scheduled to be called again on 27 February.
