Kalutara Cop Ordered to Pay Compensation for Helmet Assault on Motorcycle Rider

The Supreme Court has ruled that a police constable attached to the Kalutara Police must pay Rs. 1 million in compensation for violating the fundamental rights of a school caretaker. The court also ordered the government to pay Rs. 30,000 in compensation and Rs. 25,000 in legal costs.

The case involved Manoj Shamika, a resident of Kalutara and a school caretaker, who was allegedly riding a motorcycle without wearing a helmet and under the influence of alcohol. Constable Samantha Thushara of the Kalutara Police reportedly assaulted Shamika with a helmet, leaving him unconscious.

Despite the allegations, the court found that the constable’s actions infringed on Shamika’s fundamental rights.

The Supreme Court delivered this verdict following a fundamental rights petition filed by Manoj Shamika regarding the incident in the Kalutara area.
