Supreme Court Reserves Order On Sarath De Abrew Fundamental Rights Petition

December 12, 2015

The Supreme Court yesterday reserved its order for January 11 over granting leave to proceed with a Fundamental Rights petition filed by Justice Sarath de Abrew.

This direction was given yesterday by a three-member-Bench headed by Chief Justice K. Sripavan when the FR petition filed by Abrew against his indictment was considered.

The Supreme Court instructed the parties to file written submissions before December 18.

Meanwhile, the Attorney General assured that a charge sheet would not be filed in the Mount Lavinia Magistrate's Court against Justice Abrew, when the case is called on January 11.

The Attorney General indicted Sarath de Abrew at the Colombo High Court on two counts on committing grave sexual abuse, under Section 365 (B) of the Penal Code.

A separate legal action continues at the Mt Lavinia Magistrate's Court on causing voluntary hurt, under Section 314 of the Penal Code.
