Court Of Appeal Rejects Petition Seeking Reinstatement Of Sarath Fonseka As MP

Court of Appeal today dismissed a writ petition filed by Democratic Party leader Sarath Fonseka seeking his reinstatement as a member of parliament, removing MP Jayantha Katagoda.
 
Fonseka asked the Court of Appeal to direct the Parliament General Secretary to reinstate him since he has been pardoned by the President.
 
However, the Court of Appeal directed that there is no legal provision to reinstate him under the Parliamentary Elections Act or other existing constitutional laws.
 
The petition was heard before a two member bench comprising of Court of appeal Chairman Justice Vijith Malalgoda and Justice H. C. A. Madawala.
